Who we are.
TBakes (“we”, “us”, “our”) is a home-based baking business in Ontario, Canada. This Privacy Policy explains how we collect, use, disclose, and protect personal information in the course of our business.

What we collect.

  • Identity & contact: name, email, phone.

  • Order details: items ordered, quantities, notes (e.g., inscriptions), preferred pickup/delivery time.

  • Delivery & billing: addresses, postal code.

  • Payment: processed securely by our payment provider; we do not store full card numbers.

  • Marketing preferences and communications with us.

  • Website/app usage data (e.g., cookies, order form analytics) if enabled.

Why we collect it (our purposes).

  • Accept and fulfill orders (including pickup/delivery coordination).

  • Process payments and issue refunds when applicable.

  • Provide customer support and service updates (e.g., pickup timing).

  • Send optional marketing messages if you consent, with an unsubscribe in every message.

  • Maintain records, prevent fraud, and comply with law.

Consent & your choices.
By ordering or contacting us, you consent to the collection and use of your information for the purposes above. You may withdraw consent to optional marketing at any time via “unsubscribe” or by contacting us. You may request access to, or correction of, your personal information.

Email & text marketing (CASL).
We only send commercial electronic messages with consent and always include our business identification and an unsubscribe mechanism.

Sharing your information.
We share personal information with service providers who help us operate (e.g., payment processors, email/SMS services, delivery couriers). These providers may store data in or outside Canada and are contractually limited to using it only to provide their services. We do not sell personal information.

Retention.
We keep order and transaction records as required for tax, bookkeeping, and legal purposes, then securely delete or de-identify them.

Security.
We use reasonable physical, organizational, and technical safeguards appropriate to the sensitivity of the information.

Children.
Our site is not intended for children under 13. If you believe a child’s data was provided without consent, contact us to remove it.

Cookies & analytics.
If we use cookies/analytics, they help operate the site and understand demand. Your browser may let you block cookies, but some features may not work.

Terms & Conditions

These Terms govern orders placed with TBakes. By placing an order, you agree to them.

1) Orders & Payment

1.1 Custom, made-to-order goods. All products are baked to order and may vary slightly in appearance.
1.2 Lead time & payment deadline. Payment must be received at least 48 hours before the scheduled pickup or delivery time. Orders placed within 48 hours are subject to acceptance and may require immediate full payment or may be declined.
1.3 Invoices & methods. We issue an invoice with a secure payment link. Your order is not confirmed until payment is received. HST will be added if applicable.
1.4 Non-payment. If payment is not received by the deadline, we may cancel the order and release the slot.

2) Changes & Add-Ons

2.1 Change window. You cannot add to or change your order less than 24 hours before the scheduled pickup or delivery time.
2.2 Earlier changes. Changes requested more than 24 hours before the scheduled time are subject to availability and may affect price.

3) Cancellations & Refunds

3.1 Customer cancellation ≥ 24 hours before the scheduled time: full refund of product charges and any paid delivery fee.
3.2 Customer cancellation < 24 hours before the scheduled time:

  • Product charges: non-refundable.

  • Delivery fee (if already paid): refunded.
    3.3 Our cancellation. If we must cancel for reasons within our control, you’ll receive a full refund (product + delivery fee).
    3.4 Refund method. Approved refunds are returned to the original payment method within 7 business days (processing times may vary by your bank).

4) Delivery & Pickup

4.1 Delivery destination. Once a delivery fee has been quoted and paid, you may not change the delivery destination. A new address requires a new quote and additional payment (if accepted) or cancellation subject to Section 3.
4.2 Delivery window & access. You’re responsible for providing accurate address details and ensuring someone is available to receive the order during the agreed window. Risk of loss passes on delivery to the address provided or to the concierge/recipient you designate.
4.3 Pickup privacy & timing. For home-based safety, the exact pickup location will be shared 24 hours before your pickup time to confirmed, paid orders. Bring your order confirmation or ID.
4.4 Missed pickup/attempts. If you miss the pickup window or delivery attempt due to customer unavailability or wrong details, additional fees may apply for a new time slot. Perishable items are not held beyond the same day without prior arrangement.

5) Allergens, Food Safety & Storage

5.1 Allergen disclosure. Our products may contain or come into contact with priority allergens (e.g., nuts, peanuts, eggs, milk, wheat/gluten, soy). Cross-contact is possible in a home kitchen. If you have severe allergies, please consider this risk before ordering.
5.2 Handling & storage. We provide general storage guidance; you are responsible for promptly refrigerating or consuming items as advised. We are not responsible for spoilage after pickup/delivery caused by improper handling or delays.

6) Quality & Substitutions

6.1 Reasonable variations. Colours, piping, and decorations may vary slightly from photos due to handcrafting and ingredient availability.
6.2 Substitutions. If a specific decoration or ingredient is unavailable, we may substitute a comparable item of equal or higher quality without materially changing the design.

7) Photos & Promotion

7.1 We may photograph completed products and use non-identifying images for our portfolio and social channels. We will not publish your personal contact details.

8) Pricing, Taxes & Errors

8.1 Prices are in CAD and subject to HST where applicable.
8.2 We may correct typographical errors or inaccuracies; if a correction materially affects your order, you may cancel for a full refund.

9) Limits of Liability

9.1 To the maximum extent permitted by Ontario law, our liability for any claim arising from an order is limited to the amount you paid for that order. We are not liable for indirect or consequential losses (e.g., event costs) unless required by law.

10) Force Majeure

10.1 We aren’t responsible for delays or non-performance due to events beyond our reasonable control (e.g., severe weather, power outages, illness, supply interruptions). If affected, we’ll offer a reschedule or refund.

11) Governing Law & Disputes

11.1 These Terms are governed by the laws of Ontario, Canada.
11.2 Disputes may be brought in the Ontario courts, including Small Claims Court where jurisdictional limits apply.
